5) Contacting us

5.1 Personal data is collected when contacting us (e.g. via contact form or e-mail). Which data is collected when using a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of answering your request or for contacting you and the associated technical administration. The legal basis for processing this data is our legitimate interest in responding to your request in accordance with Art. 6 Para. 1 lit. f DSGVO. If your contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 (1) lit. b DSGVO. Your data will be deleted after your request has been processed. This is the case if it can be inferred from the circumstances that the matter concerned has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

5.2 WhatsApp business

We offer visitors to our website the possibility to contact us via the messaging service WhatsApp of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. For this purpose, we use the so-called “business version” of WhatsApp.

If you contact us via WhatsApp on the occasion of a specific transaction (e.g. an order placed), we store and use the mobile phone number you use on WhatsApp and – if provided – your first and last name in accordance with Art. 6 Para. 1 lit. b. DSGVO to process and respond to your request. On the basis of the same legal basis, we may ask you to provide further data (order number, customer number, address or email address) via WhatsApp in order to be able to assign your request to a specific process.

If you use our WhatsApp contact for general enquiries (such as about the range of services, availability or our website), we will store and use the mobile phone number you used on WhatsApp and – if provided – your first and last name in accordance with Art. 6 (1) lit. f DSGVO on the basis of our legitimate interest in providing the requested information efficiently and promptly.

Your data will only ever be used to respond to your request via WhatsApp. It will not be passed on to third parties.

Please note that WhatsApp Business obtains access to the address book of the mobile device we use for this purpose and automatically transfers telephone numbers stored in the address book to a server of the parent company Facebook Inc. in the USA. For the operation of our WhatsApp business account, we use a mobile device whose address book only stores the WhatsApp contact data of those users who have also contacted us via WhatsApp.

This ensures that each person whose WhatsApp contact data is stored in our address book has already consented to the transmission of his or her WhatsApp telephone number from the address books of his or her chat contacts in accordance with Art. 6 (1) lit. a DSGVO when using the app on his or her device for the first time by accepting the WhatsApp terms of use. A transmission of data of such users who do not use WhatsApp and/or have not contacted us via WhatsApp is excluded in this respect.

6) Data processing when opening a customer account and for contract processing

Pursuant to Art. 6 para. 1 lit. b DSGVO, personal data will continue to be collected and processed if you provide it to us for the performance of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. Deletion of your customer account is possible at any time and can be done by sending a message to the above address of the person responsible. We store and use the data provided by you for the purpose of processing the contract. After complete processing of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial law retention periods and deleted after expiry of these periods, unless you have expressly consented to a further use of your data or a legally permitted further use of data has been reserved on our part.

7) Use of single sign-on procedures

7.1 Facebook Connect

On our website, you can log in to create a customer account or register using the social plugin “Facebook Connect” of the social network Facebook, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”), within the framework of the so-called single sign-on technique, if you have a Facebook profile. This information includes the user ID, name, profile picture, age and gender.

We would like to point out that, following changes to Facebook’s data protection conditions and terms of use, consent may also result in the transfer of your profile pictures, your friends’ user IDs and the friends list if these have been marked as “public” in your privacy settings on Facebook. The data transmitted by Facebook will be stored and processed by us for the creation of a user account with the necessary data (title, first name, surname, address data, country, e-mail address, date of birth), if you have released them for this purpose at Facebook. 8) Use of customer data for direct marketing purposes

8.1 Registration for our e-mail newsletter

If you register for our e-mail newsletter, we will regularly send you information about our offers. The only mandatory data for sending the newsletter is your e-mail address. The provision of further data is voluntary and will be used to address you personally. We use the so-called double opt-in procedure for sending the newsletter. This means that we will only send you an e-mail newsletter once you have expressly confirmed that you consent to receiving newsletters. We will then send you a confirmation e-mail asking you to confirm that you wish to receive the newsletter in future by clicking on an appropriate link.

By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 para. 1 lit. a DSGVO. When you register for the newsletter, we store your IP address entered by your internet service provider (ISP) as well as the date and time of registration in order to be able to trace any possible misuse of your email address at a later date. The data collected by us when you register for the newsletter is used exclusively for the purpose of addressing you in an advertising manner by way of the newsletter. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a corresponding message to the responsible person named at the beginning. After unsubscribing, your e-mail address will be deleted from our newsletter distribution list immediately, unless you have expressly consented to further use of your data or we reserve the right to use your data in a way that goes beyond this, which is permitted by law and about which we inform you in this declaration.

8.2 Newsletter dispatch via Omnisend

Our e-mail newsletters are sent via the technical service provider Omnisend (Soundest Ltd., Unit a3, Gateway Tower, 32 Western Gateway, London E16 1YL, United Kingdom), to whom we pass on the data you provided when registering for the newsletter. This transfer takes place in accordance with Art. 6 Para. 1 lit. f DSGVO and serves our legitimate interest in using an effective, secure and user-friendly newsletter system. The data you enter for the purpose of receiving the newsletter (e.g. e-mail address) is stored on Omnisend’s servers in the EU.

Omnisend uses this information to send and statistically evaluate the newsletters on our behalf. For the evaluation, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). The data is collected exclusively in pseudonymised form and is not linked to your other personal data; direct personal reference is excluded. This data is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.If you wish to object to the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.

Furthermore, Omnisend may use this data itself in accordance with Art. 6 (1) lit. f DSGVO on the basis of its own legitimate interest in the needs-based design and optimisation of the service as well as for market research purposes, for example to determine which countries the recipients come from. However, Omnisend does not use the data of our newsletter recipients to write to them itself or to pass them on to third parties.

We have concluded an order processing agreement with Omnisend, by which we oblige Omnisend to protect our customers’ data and not to pass it on to third parties.

9) Data processing for order processing

Transmission of image files for order processing via upload function. On our website, we offer customers the opportunity to order the personalisation of products by submitting image files via an upload function. The submitted image motif is used as a template for the personalisation of the selected product.

Using the upload form on the website, the customer can transmit one or more image files from the memory of the end device used directly to us via automated, encrypted data transmission. We then record, store and use the transmitted files exclusively for the production of the personalised product as defined in the respective service description on our website. If the transmitted image files are passed on to special service providers for the production and processing of the order, you will be explicitly informed of this in the following paragraphs. Any further transfer will not take place. If the transmitted files or the digital motifs contain personal data (in particular images of identifiable persons), all the processing operations just mentioned will be carried out exclusively for the purpose of processing your online order in accordance with Art. 6 para. 1 lit. b DSGVO. After final processing of the order, the transmitted image files are automatically and completely deleted.

10) Use of social media: Social plugins

10.1 Facebook plugins with 2-click solution

Our website uses so-called social plugins (“plugins”) of the social network Facebook, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).

In order to increase the protection of your data when visiting our website, the plugins are initially deactivated and integrated into the page using a so-called “2-click” solution. You can recognise deactivated plugins by the fact that they are greyed out. 11.1 Use of Vimeo videos

Plugins of the video portal Vimeo of Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA are integrated on our website. When you call up a page of our website that contains such a plugin, your browser establishes a direct connection to the Vimeo servers. The content of the plugin is transmitted by Vimeo directly to your browser and integrated into the page. Through this integration, Vimeo receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Vimeo account or are not currently logged in to Vimeo. The Google Analytics tracking tool of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, is automatically integrated into videos from Vimeo that are embedded on our site. This is Vimeo’s own tracking, to which we have no access and which cannot be influenced by our site. Google Analytics uses so-called “cookies” for tracking, which are text files that are stored on your computer and enable an analysis of your use of the website. 11.2 Use of Youtube videos

This website uses the Youtube embedding function to display and play videos from the provider “Youtube”, which belongs to Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).

The extended data protection mode is used here, which, according to the provider, only triggers the storage of user information when the video(s) is/are played. If the playback of embedded Youtube videos is started, the provider “Youtube” uses cookies to collect information about user behaviour. According to information from “Youtube”, these are used, among other things, to collect video statistics, to improve user-friendliness and to prevent abusive behaviour. If you are logged in to Google, your data will be directly assigned to your account when you click on a video. If you do not wish to have your data associated with your YouTube profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation is carried out in particular in accordance with Art. 6 para. 1 lit. f DSGVO on the basis of Google’s legitimate interests in the display of personalised advertising, market research and/or needs-based design of its website. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right. The use of YouTube may also result in the transmission of personal data to the servers of Google LLC. in the USA.

Independently of a playback of the embedded videos, a connection to the Google network is established each time this website is called up, which may trigger further data processing operations without our influence.

12) Online marketing

Facebook Pixel for the creation of Custom Audiences with extended data matching (with Cookie-Consent-Tool)

Within our online offer, the so-called “Facebook Pixel” of the social network Facebook is used in the mode of extended data matching, which is operated by Facebook Ireland Limited, 4 Grand Canal Quare, Dublin 2, Ireland (“Facebook”).

On the basis of the user’s express consent, when a user clicks on an advertisement played on Facebook and placed by us, an addition is added to the URL of our linked page by Facebook Pixel. After forwarding, this URL parameter is then inscribed in the user’s browser via a cookie, which our linked page sets itself. In addition, this cookie collects specific customer data, such as the email address, which we collect on our website linked to the Facebook ad during transactions such as purchase transactions, account logins or registrations (extended data matching). The cookie is then read by Facebook Pixel and enables the data, including the specific customer data, to be forwarded to Facebook.

With the help of the Facebook Pixel with extended data matching, it is possible for Facebook, on the one hand, to precisely determine the visitors to our online offer as a target group for the display of advertisements (so-called “Facebook Ads”). Accordingly, we use the Facebook pixel with advanced data matching to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited), which we transmit to Facebook (so-called “Custom Audiences”). With the help of the Facebook pixel with advanced data matching, we also want to ensure that our Facebook ads correspond to the potential interest of the users and do not have a harassing effect. This allows us to further evaluate the effectiveness of the Facebook ads for statistical and market research purposes by tracking whether users were redirected to our website after clicking on a Facebook ad (so-called “conversion”). Compared to the standard variant of Facebook Pixel, the extended data matching function helps us to better measure the effectiveness of our advertising campaigns by capturing more attributed conversions.

All transmitted data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes, in accordance with the Facebook data usage policy (https://www.facebook.com/about/privacy/). The data may enable Facebook and its partners to serve ads on and off Facebook.

These processing operations will only be carried out if explicit consent is given in accordance with Art. 6 (1) lit. a DSGVO.

13) Google Customer Reviews (formerly Google Certified Merchant Programme)

We work with Google as part of the “Google Customer Reviews” programme. The provider is Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). This programme gives us the opportunity to collect customer reviews from users of our website. This involves asking you, after you have made a purchase on our website, whether you would like to take part in an email survey from Google. If you give your consent in accordance with Art. 6 para. 1 lit. a DSGVO, we will transmit your email address to Google. You will receive an email from Google Customer Reviews asking you to rate the purchase experience on our website. The rating you provide will then be aggregated with our other ratings and displayed in our Google Customer Reviews logo and in our Merchant Center dashboard. In addition, your review will be used for Google Seller Reviews. The use of Google Customer Reviews may also involve the transmission of personal data to the servers of Google LLC. in the USA.

You can revoke your consent at any time by sending a message to the data controller or to Google.

14) Applying for jobs by email

We advertise current vacancies on our website in a separate section, for which interested parties can apply by e-mail to the contact address provided.

In order to be included in the application process, applicants must provide us with all personal data required for a well-founded and informed assessment and selection together with their application by e-mail.

The required information includes general personal information (name, address, telephone or electronic contact details) as well as performance-related evidence of the qualifications required for a position. If necessary, health-related information may also be required, which must be given special consideration under labour and social law in the interest of social protection in the person of the applicant.

The components that an application must contain in order to be considered in each individual case and the form in which these components must be sent by e-mail can be found in the respective job advertisement.

After receipt of the application sent using the specified e-mail contact address, the applicant data will be stored by us and evaluated exclusively for the purpose of processing the application. For queries arising in the course of processing, we use, at our discretion, either the e-mail address provided by the applicant with his/her application or a telephone number provided.

The legal basis for this processing, including contacting us for queries, is generally Art. 6 Para. 1 lit. b DSGVO (for processing in Germany in conjunction with § 26 Para. 1 BDSG), in the sense of which the application process is considered to be the initiation of an employment contract.

Insofar as special categories of personal data within the meaning of Art. 9 (1) DSGVO (e.g. health data such as information on severely disabled status) are requested from applicants as part of the application process, the processing is carried out in accordance with Art. 9 (2) lit. b. DSGVO. DSGVO so that we can exercise the rights arising from labour law and social security and social protection law and fulfil our obligations in this regard.

Cumulatively or alternatively, the processing of the special categories of data may also be based on Article 9(1)(h) of the GDPR if it is carried out for the purposes of preventive health care or occupational medicine, for the assessment of the applicant’s fitness for work, for medical diagnosis, health or social care or treatment, or for the management of health or social care systems and services.

If the applicant is not selected in the course of the evaluation described above or if an applicant withdraws his or her application prematurely, his or her data transmitted by e-mail as well as all electronic correspondence including the original application e-mail will be deleted at the latest after 6 months following notification. This period is measured on the basis of our legitimate interest in answering any follow-up questions about the application and, if necessary, to be able to comply with our obligations to provide evidence under the regulations on equal treatment of applicants.

In the event of a successful application, the data provided will be further processed on the basis of Art. 6 para. 1 lit. b DSGVO (for processing in Germany in conjunction with § 26 para. 1 BDSG) for the purposes of implementing the employment relationship.

15) Rights of the data subject

15.1 The applicable data protection law grants you comprehensive data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, which we inform you about below:

Right of access pursuant to Art. 15 DSGVO: In particular, you have the right to obtain information about your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the intended storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it has not been collected from you by us, the existence of automated decision-making including profiling and, if applicable, meaningful information about the logic involved and the scope and the intended effects of such processing concerning you, as well as your right to be informed about which guarantees exist in accordance with Art. 46 DSGVO in case of transfer of your data to third countries;

Right to rectification pursuant to Art. 16 of the GDPR: You have the right to have any inaccurate data relating to you rectified without delay and/or to have any incomplete data stored by us completed;

Right to deletion pursuant to Art. 17 DSGVO: You have the right to demand the deletion of your personal data if the requirements of Art. 17 (1) DSGVO are met. However, this right does not exist in particular if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;

Right to restriction of processing pursuant to Art. 18 of the GDPR: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data, which you dispute, is being verified; if you refuse the erasure of your data due to unlawful data processing and instead request the restriction of the processing of your data; if you require your data for the assertion, exercise or defence of legal claims after we no longer need this data after the purpose has been achieved; or if you have lodged an objection for reasons relating to your particular situation as long as it has not yet been determined whether our legitimate grounds prevail;

Right to information pursuant to Art. 19 DSGVO: If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.

Right to data portability pursuant to Art. 20 DSGVO: You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller, insofar as this is technically feasible;

Right to revoke consent given in accordance with Art. 7 (3) DSGVO: You have the right to revoke consent to the processing of data once given at any time with effect for the future. In the event of revocation, we will immediately delete the data concerned unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation;

Right to lodge a complaint pursuant to Art. 77 GDPR: If you consider that the processing of personal data concerning you infringes the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, workplace or the place of the alleged infringement, without prejudice to any other administrative or judicial remedy.

15.2 RIGHT OF OBJECTION

IF WE PROCESS YOUR PERSONAL DATA WITHIN THE FRAMEWORK OF A BALANCING OF INTERESTS ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE AT ANY TIME ON GROUNDS ARISING FROM YOUR PARTICULAR SITUATION.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO CONTINUE PROCESSING IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING IS FOR THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS.

IF WE PROCESS YOUR PERSONAL DATA FOR THE PURPOSES OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSES OF SUCH MARKETING. YOU MAY EXERCISE THE RIGHT TO OBJECT AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

16) Duration of storage of personal data

The duration of the storage of personal data is measured on the basis of the respective legal basis, the processing purpose and – if relevant – additionally on the basis of the respective statutory retention period (e.g. retention periods under commercial and tax law).

When processing personal data on the basis of explicit consent pursuant to Art. 6 para. 1 lit. a DSGVO, this data is stored until the data subject revokes his/her consent.

If there are statutory retention periods for data that is processed within the scope of legal or quasi-legal obligations on the basis of Art. 6 Para. 1 lit. b DSGVO, this data will be routinely deleted after expiry of the retention periods, insofar as it is no longer required for the fulfilment of a contract or the initiation of a contract and/or there is no further justified interest on our part in continuing to store it.

When processing personal data on the basis of Art. 6(1)(f) DSGVO, such data shall be stored until the data subject exercises his/her right to object pursuant to Art. 21(1) DSGVO, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.

When processing personal data for the purpose of direct marketing on the basis of Art. 6(1)(f) DSGVO, such data shall be stored until the data subject exercises his or her right to object pursuant to Art. 21(2) DSGVO.

Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
